4. Information We Collect and How We Collect It
We collect several types of information from and about users of the Platform or services, including information:

• by which you may be personally identified, such as name, postal address, e-mail address, phone number, or any other identifier by which you may be contacted online or offline ("personal information");

• you may submit to us, including any Content that has personal information;

• about your preferences, partnerships and affiliations, and demographics or

• geolocation, including precise and regional;

• about you individually but does not identify you;

• about your internet connection, the equipment you use to access our Platform, and Platform usage details;

• account information and login credentials;

• chat modules, messaging and email data, including related metrics;

• occupation history;

• financial and economic information, including, without limitation, your revenue;

• survey, participation, and general research data; and

• contests, sweepstakes, giveaways, and prize drawings data.

We collect this information:

• directly from you when you provide it to us, such as when you create an account, or contact us with inquiries; and

• automatically as you use the Platform.  Information collected automatically may include usage details, and information collected through cookies.

By voluntarily providing us with any such information, you are consenting to our use of it in accordance with this Privacy Notice.  You can choose not to provide us with certain information, but then you may not be able to take advantage of many features or opportunities.
Automatically Collected Information
Upon engaging the Platform or services, the Kajabi automatically receives and records information on our server logs from your browser, including but not limited to your IP address, the type of browser used, identity and type of device used, cookie information, the page you requested, and duration of activity on our Platform. Kajabi may store such information itself or such information may be included in databases owned and maintained by Kajabi and its affiliates within our corporate family, agents or service providers. This information may be used to customize the content you see on our Platform or to communicate with you about opportunities. This information provides us with the type of user who is accessing our Platform and certain browsing activities of that user. We may make extensive use of this data at an aggregated level to understand, among other things, how our Platform is being used. Kajabi may share this aggregate data with its affiliates within our corporate family, agents and business partners.  Kajabi may also disclose aggregated user statistics to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.  Please note that we have the ability to retain any data that you provide or that we collect on our Platform, even if you have not created an account, logged in or if you do not use our Platform. For example, such contact details and data may be used to contact you to share opportunities or for marketing purposes.
Cookies
We use "cookies" and other tracking technologies to improve your experience and to save you time and when visiting the Platform. Cookies are little tags that are placed onto your computer. We assign a cookie to your computer when you first visit us in order to enable us to recognize you each time you return. Cookies allows us to customize the Platform to your individual preferences in order to create a more personalized experience. On most web browsers, you will find a “help” section on the toolbar. Please refer to this section for information on how to receive notification when you are receiving a new cookie and how to turn cookies off. We recommend that you leave cookies turned on because they enable you to take advantage of some of the Platform’s features. Do Not Track
We may track users’ use of the Platform, but because there is no common understanding of what a “Do Not Track” signal is supposed to mean, we will not respond to browser Do Not Track (DNT) signals. For more information on DNT settings generally, please visit https://allaboutdnt.com.

 

5. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

• To provide the Platform and its contents to you.

• To process transactions and fulfill orders, including billing and collections.

• To register a user.

• To provide you with marketing and promotions, and for us to audit the same.

• To provide you with information, opportunities, or services, including customer support, that you request from us.

• To provide you with notices about your account, promotions, partner agreement, or other agreements.

• To carry out our obligations and rights arising from any contracts entered into between you and us.

• To defend against claims and litigation.

• To enforce our policies and protect against security incidents, including to prevent fraud, malicious, deceptive or illegal activity.

• To notify you about changes to the Platform or any products or services we offer to provide through it.

• To fulfill any other purpose for which you provide it.

• In any other way we may describe when you provide the information.

• For any purpose with your consent.

You may notify us to opt-out from receiving certain marketing emails and each marketing email will include an opt-out button or unsubscribe link.

SMS / Text Messaging

Kajabi may offer SMS and text messaging programs ("SMS Programs") in connection with the Platform. This section describes the additional data practices specific to those SMS Programs and supplements the information provided elsewhere in this Privacy Notice. The SMS Programs are governed by Kajabi's SMS Terms and Conditions, available at https://legal.kajabi.com/policies/sms-terms.

• Information we collect in connection with SMS Programs. When you opt in to receive SMS messages from Kajabi — for example, by providing your phone number on the Platform, clicking a link in an email from Kajabi, or replying with a keyword to a Kajabi text message — we collect your mobile phone number, a record of your consent (including the date, time, and method of opt-in), and information about your SMS interactions (such as message delivery status and opt-out requests). This information is collected and used as described in Sections 4 and 5 of this Privacy Notice.‍

• How we use SMS data. We use your mobile phone number solely to send you text messages related to the Kajabi SMS Program(s) you opted into, which may include account notifications, transactional messages, milestone celebrations, event reminders, product updates, and other communications described at the point of opt-in.‍

• No third-party sharing of SMS data for marketing. Notwithstanding any other provision of this Privacy Notice, your mobile phone number, SMS opt-in data, and consent information will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. This data may only be shared with service providers who assist us in delivering SMS messages (such as our telephony and communications providers), consistent with the practices described in Section 6 (Disclosure of Your Information). Those providers are contractually prohibited from using your information for any purpose other than delivering messages on our behalf.‍

• Opt-out. You may revoke your consent to receive SMS messages at any time by texting STOP to the number from which you received a message. For additional help, text HELP or contact us at support@kajabi.com.‍

• Data retention. We retain your mobile number and consent records for as long as you remain opted in to an SMS Program and for a reasonable period afterward to comply with applicable legal obligations and to resolve disputes, consistent with the retention practices described elsewhere in this Privacy Notice.

Notwithstanding any other provision of this Privacy Notice, the protections described in this SMS section govern all data collected in connection with Kajabi's SMS Programs. To the extent any other section of this Privacy Notice describes broader data sharing practices, those practices do not apply to mobile phone numbers, SMS opt-in data, or consent information collected through any SMS Program."
